Terms of Service
Effective date: October 7, 2026
These Terms govern access to and use of workpods.ai, the WorkPods platform, and related services. Please read them before using WorkPods.
Agreement and order of precedence
By accessing or using WorkPods, creating an account, accepting an order form, or using a workspace provided by an organization, you agree to these Terms. If you use WorkPods for an organization, you represent that you have authority to bind that organization, and “you” includes the organization.
An order form, statement of work, or other written agreement signed by you and WorkPods may contain additional or different terms. That signed agreement controls if it conflicts with these Terms. The Privacy Policy is incorporated into these Terms.
Eligibility and accounts
WorkPods is a business service. You must be legally able to enter into a binding contract and must not use the service if prohibited by applicable law. You are responsible for accurate account information, safeguarding credentials, activity under your account, and promptly notifying us of suspected unauthorized access.
Workspace administrators may invite or remove users, assign roles, connect data sources, and control workspace content. If an organization provides your account, its administrator may access and manage that account and its workspace data.
The service
WorkPods provides AI-assisted marketing intelligence and execution features, including connected-source collection, dashboards, evidence, audits, analyses, recommendations, drafts, approvals, and workflow support. Features may vary by plan, order, workspace, region, source availability, and deployment stage.
We may improve, add, change, or discontinue features. We will provide reasonable notice of a material reduction to paid service functionality when practical, unless an urgent security, legal, provider, or operational issue requires faster action.
Connected services
You may authorize WorkPods to connect to services such as Google Search Console, Google Analytics, Google Ads, Meta, content systems, or communications providers. You represent that you have the right to connect each account and permit WorkPods to access and process its data for the features you select.
Third-party services are governed by their own terms and policies. Their availability, data, permissions, and behavior are outside our control. You can disconnect a source in WorkPods and may also need to revoke access with the provider. Our handling of connected data, including data received from Google and Meta, is described in the Privacy Policy.
Meta permissions and use
A Meta connection may request ads_read to read advertising information and business_management to identify the business assets and ad accounts you may select. WorkPods currently uses those permissions for account discovery, connection health, paid-media reporting, analysis, and recommendations. It does not use them to create, edit, or delete Meta ads, manage unrelated business assets, or publish content to Facebook or Instagram.
You remain responsible for complying with Meta's terms and policies and for maintaining the authority required to connect each Meta business or ad account. If a future feature needs expanded permissions or can execute a Meta action, WorkPods will identify the new access or action and request any additional permission and user approval required before using it.
Your data and content
As between you and WorkPods, you retain ownership of information, content, instructions, and materials you or your authorized sources provide to the service (“Customer Data”). You grant WorkPods a non-exclusive, worldwide right to host, copy, transmit, process, display, and create service outputs from Customer Data only as needed to provide, secure, support, and improve the contracted service and comply with law.
You are responsible for Customer Data, the permissions and notices required to provide it, and the legality of instructions you give us. Do not provide data that you are not authorized to use or that the service is not designed to handle.
AI-assisted features and approvals
WorkPods uses automated systems and AI services to help create analyses, recommendations, drafts, and other outputs. Outputs may be incomplete, inaccurate, or unsuitable for a particular purpose. You must review outputs and verify important facts, claims, rights, targeting, budgets, and compliance before relying on or publishing them.
Some workflows may prepare or, where enabled, execute actions after an authorized user approves them. You remain responsible for approval decisions and for activity you direct. WorkPods does not provide legal, tax, financial, medical, or other regulated professional advice.
Acceptable use
You must not use WorkPods to:
- violate law, regulation, third-party rights, or provider terms;
- send unlawful, deceptive, abusive, or unsolicited communications;
- upload malware or interfere with the security, integrity, or availability of the service;
- gain unauthorized access to an account, workspace, system, or data source;
- probe, scan, or test vulnerabilities without our written permission;
- reverse engineer or circumvent service limits or access controls, except where law expressly permits;
- resell, sublicense, or make the service available to third parties except as an authorized agency or under a written agreement;
- use the service or connected data for surveillance, discrimination, credit decisions, or unlawful profiling; or
- misrepresent AI-generated content as independently verified when it has not been reviewed.
WorkPods ownership and feedback
WorkPods and its licensors own the service, software, interfaces, designs, documentation, and underlying technology, excluding Customer Data. These Terms grant only the limited right to use the service during the applicable subscription or service period; they do not transfer intellectual-property ownership.
If you provide feedback or suggestions, you permit us to use them without restriction or payment, provided we do not identify you publicly without permission.
Confidentiality
Each party may receive non-public information that a reasonable person would understand to be confidential. The receiving party will use it only to perform or receive the services, protect it with reasonable care, and disclose it only to personnel and service providers who need it and are bound by confidentiality obligations. This does not cover information lawfully known without restriction, independently developed, rightfully received from another source, or made public without breach.
Fees and taxes
Fees, payment schedules, usage limits, and subscription periods are stated in the applicable order or written agreement. Unless that agreement says otherwise, fees are non-refundable and exclude applicable taxes. You are responsible for taxes other than taxes on WorkPods' net income. We may suspend paid features for overdue undisputed amounts after reasonable notice.
Suspension and termination
You may stop using the service at any time, subject to your order or written agreement. We may suspend or restrict access when reasonably necessary to address a security risk, unlawful use, material breach, overdue payment, harm to the service or others, or a provider or legal requirement. When practical, we will give notice and an opportunity to cure.
Either party may terminate for an uncured material breach after reasonable written notice, or as otherwise stated in an order. On termination, your right to use the service ends. Provisions that by their nature should survive—including payment, ownership, confidentiality, disclaimers, liability limits, indemnity, and general terms—will survive. Data retention and deletion follow the Privacy Policy and any controlling written agreement.
Disclaimers
To the maximum extent permitted by law, WorkPods is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage. We do not warrant uninterrupted or error-free operation, specific marketing results, continued availability of third-party services, or that automated or AI-generated outputs will be accurate or suitable. Rights that cannot legally be waived remain in effect.
Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, business opportunities, or data, even if advised that they may occur. WorkPods' total liability arising from the service will not exceed the fees paid or payable for the service during the 12 months before the event giving rise to the claim, or USD 100 if no fees were paid.
These limits do not apply where prohibited by law or to liability that cannot legally be limited. A controlling written agreement may provide different limitations.
Indemnity
To the extent permitted by law, you will defend and indemnify WorkPods and its personnel from third-party claims, damages, and reasonable costs arising from Customer Data, your unlawful or unauthorized use of the service, your violation of these Terms, or your infringement of another party's rights. We will provide reasonable notice and cooperation and will not settle a claim in a way that admits your fault or imposes non-monetary obligations on you without consent.
General terms
The governing law and forum stated in an applicable signed order or agreement control. If none is stated, applicable law governs without regard to conflict-of-law principles, and mandatory local rights remain unaffected. Before filing a formal claim, each party will try in good faith for 30 days to resolve the dispute through written notice.
Neither party is liable for delay caused by events beyond its reasonable control. You may not assign these Terms without our consent, except with a merger or sale of substantially all relevant assets; WorkPods may assign them in connection with a reorganization, merger, acquisition, or asset sale. Failure to enforce a provision is not a waiver. If a provision is unenforceable, the remainder stays effective. These Terms, the Privacy Policy, and any controlling written agreement are the entire agreement about the service.
Changes to these Terms
We may update these Terms as the service or legal requirements change. We will post the revised Terms here and update the effective date. For material changes, we will provide reasonable additional notice. Continued use after the change takes effect constitutes acceptance where permitted by law; otherwise, you may stop using the service.
